Subject: 9928/Code/Ch.10/10-6/Movable metal gates Date: Mon, 27 Feb 1989 12:20:00 -0500 ORDINANCE NO. 9928 AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, PART II, CHAPTER 10, BY ADDING A NEW SECTION 10-6, RELATIVE TO IMPOSING REQUIREMENTS UPON THE INSTALLATION OF MOVABLE METAL GATES OR BARRIERS UPON BUSINESSES LOCATED WITHIN THE DOWNTOWN AREA OF THE CITY OF CHATTANOOGA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE: SECTION 1. That Chattanooga City Code, Part II, Chapter 10, be and is hereby amended to include a new Section 10-6 to impose regulations upon business owners wishing to install or maintain metal gates or barriers upon their businesses located within the Downtown Area of the City of Chattanooga as follows: Sec. 10-6. Installation of metal gates or barriers within the Downtown Area of the city-- prohibited. (a) In the interest of public safety and in the interest of the safety of city employees responding to fire calls within the Downtown Area as hereinafter defined, movable metal gates or movable metal barriers which may be locked during any portion of the day or night upon the entrances, exits and windows of any business within the Downtown Area of the City of Chattanooga is expressly prohibited. (b) "Movable metal gates" or "metal barriers" shall be defined to include the following: i) roll down security doors, ii) metal security doors on hinges composed of bars, metal screen, or interlocking metal pieces, or 0C iii) any permanent metal security barrier which is constructed on the exterior or interior of the entrance, exit or window of any structure located within the Downtown Area of the city for the purpose of preventing access into any structure and which is capable of being locked from the interior or exterior of the structure during any portion of the day or night. (c) This section shall not be construed to prevent any tenant or owner within the Downtown Area from installing doors and windows upon any structure which are determined by the Building Official and the Fire Marshall to fully comply with the Building Code and Fire Safety Codes adopted by the City of Chattanooga other than movable metal gates or metal barriers. (d) For the purposes of this Ordinance, the "Downtown Area" is defined to be the area bounded by the centerline of Martin Luther King, Jr. Boulevard on the south, a line twenty feet (20') west of the city right-of-way on Chestnut Street (extended) on the west, the Tennessee River on the north, and a line twenty feet (20') east of the city right-of-way on Cherry Street (extended) on the east. SECTION 2. That this ordinance shall be effective two (2) weeks from and after its passage as provided by law.
